This Terms of Service and User Agreement is established to govern the online services and paid add-on content for FOAMSTARS (hereinafter referred to as "the Service"), operated by SQUARE ENIX CO., LTD (hereinafter referred to as "the Company"). This Terms of Service and User Agreement applies to all users of the Service and purchasers of paid add-on content.

1. Usage of the Service
   This Terms of Service and User Agreement is in place to allow users of the Service to enjoy it in a safe and secure environment, and all users agree to abide by it. Any users who are unable to agree to them should refrain from using the Service.

2. Users are forbidden from acting in a way that would exert a negative influence on the experience of other users' gameplay (hereinafter referred to as "Prohibited Conduct"), as judged by the Company. Examples of Prohibited Conduct follow:
   
   Examples of Prohibited Conduct

• Obstructing gameplay via intentional inactivity or connection interruption.
• Obstructing gameplay by aiding the opposing team, being uncooperative, or intentionally unskilled.
• Creating, using. or distributing prohibited programs, external tools, or utilities.
• Maliciously using in-game bugs or exploits to benefit oneself or one's team, or to disadvantage your opponents.
• Modifying, recombining, reverse-engineering, or analyzing game data.
• Creating or posting content using the lounge decoration feature that falls into the following categories:
  • Representations of gore (excessive injuries, wounds or blood), nudity or sexual content
  • Content that goes against social standards and morals
  • Content created to make others uncomfortable
  • Content containing personally identifiable information
  • Content that infringes upon the intellectual property rights of others, or has the potential to do so
  • Content that defames, libels, or threatens a specific individual or organization

3. Events utilizing the Service organized by individuals, such as tournaments, are allowed provided they do not fall under the following categories:
   ① Anything involving Prohibited Conduct outlined in Section 2 above.
   ② Anything for commercial gain or profit.
   ③ Anything contravening any applicable laws, regulations, rules, or social norms.

4. If Prohibited Conduct is identified, as punishment the Company may suspend the offending user's access to the Service temporarily or permanently.

5. Any actions taken by the Company when a user is reported by other users to have engaged in Prohibited Conduct are at the Company's discretion, and the Company is under no obligation to inform the reported user.

6. The Company will monitor users to ensure compliance with these Terms of Service and User Agreement. The Company will process information obtained from users as part of the provision of the Service (including through monitoring) in accordance with its Privacy Notice.

Purchasing Paid Add-On Content

7. FOAMSTARS contains paid add-on content. When purchasing paid add-on content, the following clauses apply based on the country or region in which the user resides.

• Users residing in Brazil, Canada, Mexico, or the United States of America:
  • Purchase and use of items are subject to the Network Terms of Service and User Agreement. This online service has been sublicensed to you by Sony Interactive Entertainment America.
    
    
• Users residing in Australia, Austria, Belgium, Croatia, Czechia, Denmark, Finland, France, Germany, Greece, India, Ireland, Israel, Italy, Kuwait, Luxembourg, Netherlands, New Zealand, Norway, Poland, Portugal, Russia, Saudi Arabia, Slovenia, South Africa, Spain, Sweden, Switzerland, Türkiye, United Arab Emirates, United Kingdom, or Ukraine:
  • Any content purchased in an in-game store will be purchased from Sony Interactive Entertainment Network Europe Limited (“SIENE”) and be subject to PlayStation™Network Terms of Service and User Agreement which is available on the PlayStation™Store. Please check usage rights for each purchase as these may differ from item to item.

Unless otherwise shown, content available in any in-game store has the same age rating as the game.
