I AM SETSUNA (“Game”) Fan-Art Competition(“Fan Submission”)
This Fan Submission is being operated and promoted by:
Square Enix Limited registered in England and Wales with company number 01840186 (“Square Enix”, “We”, “we”, “Us”, “Our”) with registered address at 240 Blackfriars Road, London SE1 8NW.
The Fan Submission is only open to holders of a Square Enix service account (“Service Account”) during the Entry Period who are residents of Austria, Germany, the Netherlands, Norway, and the United Kingdom (the “Territory”) (“Entrants”, “You”, “you”, “Your”, “your”).
PLEASE READ THESE RULES (“Rules”) CAREFULLY. By submitting an Entry to the Fan Submission you agree to accept and be bound by these Rules and the terms of any policies referred to in these Rules. We reserve the right to cancel or amend the Fan Submission at any stage if deemed necessary in our opinion and/or if circumstances arise which are outside of our control.
Basic Entry Requirements
Entrants must possess a Service Account and have access to a working internet connection and web browser in order to be able to enter. Entrants are responsible for all connection charges associated with the internet connection associated with the registration for a Service Account (accounts are available for free).
Entrants must accept our privacy policy located here and cookies policy located here. Entrants must have a permanent residence in the Territory. Entrants under the age of 18 must obtain the permission of a legal guardian before submitting entries. The Fan Submission is not open to employees, directors or other officers of Square Enix or its respective affiliates, agents, media partners and suppliers.
How to Enter
Create and submit your original and custom-created artwork or media inspired by the Game.
Entries must be sent using the e-mail address registered to the Service Account as an attachment (see below section for further details on format and restrictions) via email to sejcommunityeu@square-enix.com with the subject “I Am Setsuna Fan Box Art Competition”.
No other method of entry will be accepted. The body of the email should include your name and e-mail details (the “Entry Details”)
Accepted Entry Format
All Entries must be original works of the Entrant and subject to the restrictions below.
You may submit one or more custom-created artwork (“Entry”, “Entries”)
The Entry must be submitted as a digital file and available for direct download from the e-mail in the following accepted format only:

The maximum accepted e-mail size limit shall be 10 megabytes.
Entrants are responsible for the e-mail and/or attachment size limits of their e-mail service provider. Please note that Square Enix shall not be obliged to confirm receipt of the Entries.
Entry Period
13th October, 2016 8:00 a.m. (GMT) to 7th November, 2016 08:00 a.m. (GMT)
Winner Selection
The Tokyo RPG Factory development team will select four (4) winners based on overall quality, creativity and humour (the “Winner(s)”). The Winners will be announced on 14th November 2016 on the Square Enix blog located at http://eu.square-enix.com/en/home, the Square Enix official Facebook page located at https://facebook.com/SquareEnix and the Square Enix official Twitter page located at https://twitter.com/SQUARE_ENIX_EU (the “Websites”).
The Winner be will contacted by a representative of Square Enix via the e-mail used to submit the Entry and must reply to the notification message within 48 hours with the Winner’s mailing address. If the Winner fails to provide his or her mailing address within the time allotted by Square Enix, or if the Winner is not contactable by e-mail at the time Square Enix attempts to send the notification message, the Winner shall be deemed ineligible and Square Enix may select another Entrant as the Winner.
Square Enix may publicly post the Entries on Square Enix’s social media platforms.
The name of the Winner will be sent to anyone who requests the same within three (3) months of the conclusion of the Contest. Requests should be sent to Square Enix at the registered address above.
Prize
We will be awarding four (4) Winners with the following items (“Prize(s)”):
One (1) Grand Prize Winner will be awarded with the following items:

Three (3) Winners will be awarded with a 273mm x 183mm gloss print of their Entry signed by the members of Tokyo RPG Factory.
To the extent permitted by law, the Prize is awarded “AS IS” and WITHOUT ANY WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
Entrants may not win or receive more than one prize. Prizes are not transferable. Square Enix shall not provide a cash alternative in place of any Prize.
Prizes will sent to the Winner’s mailing address as provided by the Winner. Square Enix shall not be liable for any failed deliveries or returns.
Inappropriate Submissions
Entries containing obscenity, vulgarity, discrimination, or any other offensive subject matter and/or containing any plagiarized or copyrighted material will not be considered by the judges. Entries which infringe upon copyright/intellectual property, personal credit, privacy, are counter to public order and/or morals, are judged to be grossly deviant from the established theme, do not contain all of the required information or contain erroneous information may face disqualification. Square Enix reserves the right to judge whether or not material is appropriate for public display.
Assignment of Intellectual Property Rights
All entries and other materials (the "Entry Materials") (including all copyright, trademark, and other proprietary rights associated therewith) submitted by you shall become the property of Square Enix effective upon submission, and Entry Materials will not be returned to any Entrant. In consideration of our acceptance and review of your Entry Materials into the Fan Submission, you hereby assign to Square Enix absolutely all right, title and interest in perpetuity in and to the Entry Materials to which you are entitled by virtue of the laws in force in the United Kingdom and in any other part of the world, in each case for the whole term including any renewals, reversions, revivals and extensions and together with all related rights and powers arising or accrued, including the right to bring, make, oppose, defend, appeal and obtain relief (and to retain any damages recovered) in respect of any infringement, or any other cause of action arising from ownership, of any of these assigned rights. Without limiting the generality of the foregoing, you acknowledge that Square Enix will own all rights to use, modify, and make derivative works of the Entry Materials, without separate compensation to you or any other person or entity. You agree to take, at Square Enix’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Square Enix to effect, perfect, or confirm Square Enix's ownership rights as set forth above in this paragraph. Entry Materials may be used by Entrants only for purposes of the Fan Submission or for private, personal, non-public viewing. Entry materials received by Square Enix may be destroyed by Square Enix at any time following the Fan Submission.
Consent, Moral Rights and Release
You irrevocably and unconditionally grant to us and our successors, assignees and licensees all consents and licences required pursuant to the Copyright, Designs and Patents Act 1988 (“CDPA”) and all other laws now or in future in force in any part of the world which may be required for the use, recording, reproduction, distribution and other exploitation of your performance contained in the Entries whether or not as part of the Fan Submission, in any and all media by any and all means now know or invented in future throughout the world.
To the maximum extent permitted by applicable law, you irrevocably and unconditionally waive all so-called “moral rights” relating to the Entries or your performance or the Fan Submission to which you may be entitled by virtue of any law in force in any part of the world. In particular, you confirm that we may alter, adapt, change, revise, delete from, add to and/or rearrange in whole or in part the Entries and/or your performances given in relation thereto and recorded by us, in any manner we choose. You irrevocably agree that you will not in any part of the world maintain or support any claim for infringement of your moral rights by reason of any alteration or deletion from any Entries made by us, our successors, assignees and licensees
You agree to waive and release, to the fullest extent permitted by law, any and all claims, both known and unknown, against us and any of our affiliates, and their respective officers, directors, shareholders, employees, contractors and agents (collectively, “Released Parties”) based on, related to or arising from your participation in the Fan Submission, including, but not limited to, claims for personal injury, property damage, economic loss or wrongful death (other than in respect of personal injury or death due to our negligence) (collectively, “Released Claims”). In releasing claims presently unknown to you, you are waiving all rights and agree not to sue or make any claim against any of the Released Parties with respect to any of the Released Claims.
LIMITATION OF LIABILITY AND INDEMNITY
TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW SQUARE ENIX WILL NOT BE HELD RESPONSIBLE FOR ANY ENTRY THAT IS SUBMITTED TO THE FAN SUBMISSION THAT INFRINGES THE COPYRIGHT OR INTELLECTUAL PROPERTY OF A THIRD PARTY. YOU WARRANT AND AGREE THAT YOUR ENTRY WILL CONTAIN WORK THAT IS ENTIRELY ORIGINAL TO YOU AND DOES NOT INFRINGE OR INTERFERE WITH ANY THIRD PARTY COPYRIGHT OR OTHER RIGHTS AND YOU AGREE TO INDEMNIFY SQUARE ENIX AGAINST ANY LOSS ARISING OUT OF ANY BREACH OF YOUR WARRANTY.
In the event that an entry violates a third-party’s copyright, the user’s Service Account may be suspended or cancelled.
Governing Law
These Rules and all or any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales.
